Ranchi/New Delhi:: The Communist Party of India (Marxist) has strongly condemned the July 2 judgment of the Allahabad High Court in the Syed Rashid Ali vs State of Uttar Pradesh case, alleging that the ruling undermines secularism, minority rights and the livelihood of ordinary citizens.
The party also criticised the court's observations on tenants' rights, stating that most petitioners from Varanasi's Dalmandi locality had operated businesses there for generations and possessed valid tenancy documents. It cited the Social Impact Assessment report, which indicated that nearly half the affected families depended on the area for their livelihood, and alleged that the judgment failed to adequately consider their right to livelihood under Article 21 of the Constitution.
CPI(M) further alleged that the verdict reflects a broader pattern seen in other disputes involving places of worship and accused the BJP-RSS of pursuing a political agenda aimed at marginalising minorities. It also claimed that alternative routes, including Sonar Gali near the Kashi Vishwanath Temple, could have been developed with significantly less displacement than the proposed acquisition in the Muslim-majority Dalmandi area.
The party said the judgment did not sufficiently address provisions of the Right to Fair Compensation and Transparency in Land
Acquisition, Rehabilitation and Resettlement Act, 2013, which mandates rehabilitation and resettlement of affected families. CPI(M) has urged the Supreme Court of India to overturn the Allahabad High Court verdict.
